Investigation is the formal and informal process of gathering information to determine what the facts are in a case. Formal investigation involving exchanges of information between opposing attorneys as governed by court rules and sanctions is called discovery .
The primary purpose of investigation is to accumulate evidence for trial. That evidence must be evaluated to determine if it is admissible—whether it can be used in a court of law. Although investigative decisions should be made in close consultation with the supervising attorney, the more the paralegal knows about the rules of evidence, the more assistance the paralegal can provide. An efficient investigator uses a fundamental knowledge of the rules of evidence to evaluate the usefulness and admissibility of the evidence as it is gathered. Knowledge of the rules also guides the investigator to the most valuable evidence, thus saving time and money. Job satisfaction is enhanced if the paralegal understands the underlying reasons for investigative tasks
